The contracting party for all orders placed through this online offering is Stefan Fischnaller, sole proprietor, operating under the brand "Wear Your Imagination", Mentlgasse 5, 6020 Innsbruck, Austria, hereinafter referred to as "WYI".
All deliveries from WYI to the customer are made in accordance with the following General Terms and Delivery Conditions. These conditions form the basis for all offers and agreements between WYI and the customer and apply for the duration of the business relationship. Any deviating or conflicting terms of the buyer shall only be binding if confirmed in writing by WYI.
(1) The “offers” displayed on the website are a non‑binding invitation to the customer to place an order with WYI.
(2) By submitting the completed order form online, the customer makes a binding offer to conclude a purchase or work‑delivery contract. Before final submission, the customer has the opportunity on a summary page to review and, if necessary, correct their entries. The ordering process is available in the following languages: German, English.
WYI acknowledges receipt of the customer's order by e‑mail. This acknowledgement does not yet constitute acceptance of the offer but merely serves to inform that the order has been received.
The contract is only concluded when WYI ships the ordered product to the customer and confirms shipment with a further e‑mail (shipping confirmation).
The contract text is stored by us and sent to the customer by e‑mail together with the order data and these GTC.
(3) Delivery and Supply
Delivery is subject to the condition that we ourselves are supplied in a timely and complete manner. In the event of short‑term delivery delays or if the non‑delivery is our fault, this reservation lapses. In particular, we shall be liable if we fail to arrange a replacement delivery in good time.
If the ordered goods are not available, the customer will be informed immediately. Any payments already made will be refunded without delay.
(1) Single Order
A “single order” refers to the customer’s request that WYI supply printed products in accordance with the information provided by the customer. This contract applies to all single orders unless otherwise agreed in writing.
(2) Customer Information
The customer must provide WYI with all information and data required for the production and delivery of the single order. This information is referred to as “fulfilment information”. The required fields are specified in the service. For example, a delivery address for the products must be provided.
(3) Submission and Cancellation of Orders
By submitting an order via WYI’s service, the customer makes a binding offer to execute the single order in accordance with the fulfilment information and the terms of this contract. Cancellation of the single order is only possible as long as the printing process has not yet begun. To change or cancel an order, the customer must send an e‑mail to support@wear-your-imagination.com as soon as possible. If production has not yet started, the order will be cancelled or modified free of charge.
(1) The design tool (https://www.wear-your-imagination.com/designtool) and the website and all its functions are hereinafter referred to as the “Service”.
(2) License to Use the Service
All intellectual property rights and other rights to the Service are reserved. Your use of the Service does not grant you any further rights to these rights, except as follows: WYI grants you a limited, revocable license to use the Service for the intended purposes as long as this contract remains in effect.
(3) No Ownership Rights
You acknowledge that you will not represent WYI’s intellectual property as your own or use it in a misleading, deceptive, or confusing manner, and that you will not attempt to register such intellectual property. You may only use the Service in accordance with WYI’s terms.
(4) Account Information
If you provide incomplete, incorrect, or outdated information in your account, this constitutes a material breach of contract, which may result in WYI blocking or terminating your access to the Service. This also includes valid payment information and a functioning e‑mail address for communication.
(5) Maintenance and Security
You are solely responsible for protecting your access data from unauthorized access. Do not use the same access data for other websites or services. If you suspect misuse, please change your password immediately and notify us without delay.
(1) By creating and selecting a design, you confirm that it does not violate any applicable laws or infringe the rights of third parties (in particular copyrights, trademarks or personal rights). You are solely responsible for the legality of the content you upload. To use a design, you must hold all rights to that design. By using our Service, you expressly confirm that you have the right to use the design without restriction and also for commercial purposes. In the event of an infringement, you bear sole responsibility for all claims, demands and costs arising from the use of the design. You indemnify WYI against all liability.
(2) Furthermore, WYI accepts no liability for the quality, accuracy or suitability of designs created by the AI. These designs are generated automatically and may vary in content and appearance. It is your responsibility to check the suitability and quality of the designs before placing an order. WYI assumes no liability for defects or inadequacies of the designs, including blurry or inappropriate representations.
(3) Use of the AI design function is at your own risk. WYI disclaims all liability for potential copyright, personal rights or other legal infringements arising from the use, publication or distribution of the generated designs.
(4) Use by WYI
You agree that WYI may use and store the designs you generate to reproduce them, create derivative works, distribute, edit, translate, adapt, publish, publicly perform, display and modify them to design products and adjust data to meet the Service requirements.
(5) Advertising
WYI is entitled to use your AI‑generated designs for advertising purposes in all media. However, WYI is under no obligation to mention you in such advertising.
(6) Acquisition of Rights to Generated Images
To prevent WYI from using your generated designs pursuant to subsection (4), you have the option to purchase a license and thereby secure the rights to your design. If you wish to acquire the sole (exclusive) rights to a design, please contact us by e‑mail at support@wear-your-imagination.com.
(1) WYI’s Discretion
WYI may accept or reject single orders at its discretion. It is expected that most orders will be accepted, but WYI reserves the right to refuse orders without stating reasons.
(2) Product Availability
WYI provides a selection of blank products to fulfil orders. However, it cannot guarantee that all products will be available at all times, and WYI reserves the right to change the available products at its discretion.
(1) General
WYI sets the prices for products and displays them in the Service. Shipping costs are generally included in the product price or shown separately. WYI reserves the right to change prices at any time at its discretion.
(2) Discounts for Large Orders
WYI may, at its discretion, offer different pricing programs, such as reduced prices for orders above a certain amount. WYI does not guarantee the availability of such programs and may discontinue or change them at any time.
(1) General
WYI or companies commissioned by WYI organize delivery of single orders to the delivery address you provide. If no delivery address is provided, WYI reserves the right to refuse delivery or send the order to the address on file in your customer account. For orders with multiple products, you agree to receive them in multiple partial shipments if a single delivery is not possible.
(2) Costs
Shipping costs are generally included in the product price. If not, they will be shown separately during checkout. WYI reserves the right to change shipping costs at any time.
(3) Risk of Loss and Delay
The risk of loss, damage or delay passes to you once the order is handed over to the carrier. WYI is not obliged to insure deliveries or products and assumes no liability for loss, damage or delays.
(4) No Guarantee of Delivery Times
WYI may indicate approximate delivery times but does not guarantee on-time delivery.
(5) Incorrect Delivery, Insufficient Address, Uncollected Shipments
If a product is returned to WYI by the carrier due to reasons beyond WYI’s control (e.g. incorrect or insufficient address or uncollected shipment), WYI will contact you and request a corrected address to resend the product. You bear any costs incurred for storage and/or reshipment. If the product cannot be resent within 90 days of return, WYI may donate or dispose of it at your expense.
(6) Export/Import Costs
Any import duties, VAT, customs clearance fees or other legal costs in the destination country must be borne by the recipient upon receipt. If WYI incurs costs related to export or import (including duties, taxes, fees or other charges), WYI may pass these costs on to you.
(7) Delivery Destinations
Available delivery destinations (countries) can be viewed in the Service. If an order is to be delivered to a destination restricted by applicable sanctions, you acknowledge that WYI may refuse or cancel the order.
(1) General
You undertake to pay WYI for the products, printing and delivery of all single orders. Payment must be made in the currency specified by WYI.
(2) Payment Methods
You must provide payment information before production of a single order begins. WYI may offer different payment methods from time to time, which you can view in the Service. Any additional costs incurred by your chosen payment method (e.g. bank fees) are your responsibility.
(3) Payment Failures
If a chargeback occurs or your payment method fails for any reason:
(a) WYI is immediately released from all obligations under this contract and the single orders without prior notice until the error is rectified and outstanding payments are processed;
(b) you agree to bear all costs arising from the chargeback or payment failure, including processing fees, collection costs and, if applicable, reasonable attorney’s fees.
(4) Retention of Title
Products delivered by WYI ("reserved goods") remain the property of WYI until all current and future claims of WYI against you have been fully satisfied.
(1) Right of Withdrawal
Since all personalized products are custom‑made to your specifications and tailored to your personal wishes, there is no right of withdrawal for these items under applicable law. For non‑personalized products already available in our shop, you have a 14‑day return right from receipt of the goods. To exercise this return right, you must inform us by a clear declaration at support@wear-your-imagination.com.
(2) Complaints
If the goods are damaged (other than by transport) or have a production defect upon receipt, you have the right to lodge a complaint within 14 days of receipt. Please contact us immediately by e‑mail at support@wear-your-imagination.com, providing a description, a photo of the defect and the order number. We will examine the defect and, as appropriate, offer a replacement delivery, repair or refund. A complaint will only be accepted if the defect can be clearly demonstrated and the goods have not been damaged by improper handling, delivery, alteration or normal wear and tear. In the case of a justified complaint, we will cover return shipping costs. Please note that your statutory warranty rights remain unaffected.
(1) We expressly reserve the right to make reasonable deviations from descriptions and specifications in our brochures, catalogs and other written or electronic documents regarding material composition, color, weight, dimensions, design or similar characteristics, insofar as these are acceptable to you as the customer. Such deviations may occur due to customary commercial fluctuations and technical production processes.
(1) WYI processes customers’ personal data for specified purposes and in accordance with applicable legal provisions. Personal data provided in connection with ordering goods (such as name, e‑mail address, address, payment information) is used by WYI to fulfil and process the contract. This data is treated confidentially by WYI and not passed on to third parties not involved in ordering, delivery or payment. The customer has the right to obtain, free of charge, information about the personal data stored by WYI. Furthermore, the customer has the right to request correction of incorrect data, restriction or deletion of their personal data, unless statutory retention obligations prevent this.
(1) The European Commission provides a platform for online dispute resolution (ODR), which consumers can access here. WYI is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
(1) Should any provision of these General Terms and Delivery Conditions be or become invalid in whole or in part, or be contrary to law, the validity of the remaining provisions shall remain unaffected.
